This Privacy Policy describes how FutureUp Lab S.R.L. (“FutureUp Lab,” “us,” “we,” or “our”) collects, uses, and shares information about you and the choices and options you have in relation to this information.

This Privacy Policy applies to the information we collect when you access or use our products, services, and technology platforms (including the websites and mobile applications that help us provide the service, “Services”).

This Privacy Policy does not apply to your use of third-party sites, services, or applications you may access through our Services. We highly encourage you to review the privacy policies of those third parties for more information regarding their own privacy practices.

 

Section 1. Changes to this policy

We may change this Privacy Policy sometimes. In that case, we will notify you by revising the date at the top of the policy text. Depending on the cases, such as a material change in our practices, we may provide you with additional notice, such as sending you an email notification. We encourage you to review the Privacy Policy every time you access the Services to stay informed about our privacy practices and the ways you can help protect your own privacy.

 

Section 2. GDPR

If you are in the European Economic Area (“EEA”), you have certain rights and protections under the GDPR law regarding the processing of your personal data, such as the right of access, the right to rectification, the right to erasure, the right to restrict processing, the right to data portability, the right to object and also rights around automated decision making and profiling.

 

If you are in the EEA, when we process your personal data we will only do so in the following situations:

 

  • We need to use your personal data to perform our responsibilities under our contract with you such as processing payments for and providing the services you have requested.
  • We have a legitimate interest in processing your personal data. For example, we may process your personal data to send you marketing material, to communicate with you about changes to our Services, and to provide, secure, and improve our Services.
  • You have provided consent for us to process your personal data.

Section 3. Data retention

We store the information we collected about you for up to 5 years for the purpose(s) it was originally collected for, including but not limited to legitimate business purposes, as well as to meet our legal obligations.

You have the right to receive an overview of the information we store about you, and the right to update, correct or delete information about you at any time by contacting us at [email protected]. Additionally, you always have the right to withdraw your consent. Please note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you for a certain period.

Section 5. Information collection

If you visit our website or use our mobile applications, we will collect certain information about you. You can see in sections below what information we collect automatically for all users and visitors.

 

Section 6. Information you provide

We collect information you provide directly to us when using the Services.

If you are registered for the Services via your institution or employer, we will need to collect certain personal information such as your name, email address and location, which we will do so via your employer. In cases where you subscribe to our Services directly online, we may also need information such as country, your employer’s or institution’s name, your job position, role name, payment information and any other information you choose to provide.

 

Section 7. Members’ information

If you are a registered user of our Services (“Member”), we will collect information related to your use of the platform. We will collect information when you register to our Services, complete e-learning courses, download files, answer surveys or quizzes, open emails from us.

We may also collect information such as your usage of the e-learning platform, course completion rates, course subscription status, coaching subscription status coaching subscription rate. In case in which we collect information about your ratings, perception or feedback about the Services, we do not collect any personally identifying information. The exception to this is in cases you choose to provide that information to us.

 

Section 8. What we collect automatically

When you access or use our Services, there is information we collect automatically, such as:

  • Log Information: We log information about your use of the Services, including the type of browser you use, your IP address, access times, pages you view, including the page you visited before navigating to our Services.
  • Information Collected by Tracking Technologies: We use a number of tracking technologies, for example, cookies, pixels, and web beacons.
  • Browser local storage. We may also store data locally on your device to enhance the user experience for our Services. We may also use browser local storage to: (i) save a list of items the user last used on the website or Services (such as events and properties the user selected) so we can display “recently viewed items”; or (ii) marking once a user has seen a tutorial, video, tooltip or onboarding flow so that the user only sees the content one time.
  • Mobile Services. We may also collect information from your mobile device, such as but not exclusively, the first time the mobile application is opened, mobile carrier, and the type of device that is being used, if you have downloaded the mobile application. This information is useful to help us tailor relevant information to you and improve our Services.

We use tracking technologies to collect information, including cookies. These are used to make websites work more effectively and efficiently. Below you can check some of the cookies we use, the overall purpose of doing so

We may use the information we collect to maintain, improve and provide you the Services.

How we may use Member information: 

  • Provide and deliver the products and services you request, process transactions, and send you related information;
  • Verify your identity and, if applicable, authorization for you to use the Services (such as from your employer or institution);
  • Respond to your comments, questions, requests or feedback;
  • Send you technical or administrative messages;
  • Communicate with you about products, services, offers, promotions, rewards, and events offered by us or others, and provide news and information we believe will be of interest to you;
  • Monitor and analyze trends, usage and activities in connection with the Services;
  • Conduct research, analysis, and surveys;
  • Personalize and improve the Services and provide content or features that match user profiles or interests; and
  • Perform any other purpose for which the information was collected.

 

Section 12. Sharing of information

If you are a Member, when you use the Services, we may share information about you with your employer or institution who has facilitated your access to the Services. This information will be anonymized prior to it being shared and can related, among other cases, to the modules and training programs you are subscribed to, progress, coaching completion, coaching rating, aggregate survey information or any other data that enables your institution to understand the progress facilitated by using the Services.

We may also share or transfer information about you as follows or as otherwise described in this Privacy Policy:

 

  • With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf;
  • In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation, or legal process, or as otherwise required by any applicable law, rule, or regulation;
  • If we believe your actions are inconsistent with tour Terms of Service or policies, or to protect the rights, property, and safety of you, us, or others;
  • In connection with, or during negotiations of, any merger, sale of our assets, financing, or acquisition of all or a portion of our business to another company; and
  • With your consent or at your direction, including if we notify you through the Services that certain information you provide will be shared in a particular manner and you provide this information.
  • We may also share aggregated or anonymized information, which cannot reasonably be used to identify you.

 

Section 13. Analytics and advertising services

We may allow other third parties to provide analytics services on our behalf in performance of the Services. These third parties may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of the Services, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information.  This information may be used by FutureUp Lab and its third-party providers, to analyze and track data and better understand your online activity while using the Services.

 

Section 14. Transfer of information

We are based in the European Union and the information we collect is governed by Romanian law. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the European Union and other countries, where you might not have the same rights and protections as you do under local law. 

Section 15. Promotional Communications

If you are outside of the EU, you may opt out of receiving promotional communications from us by following the instructions in those communications or by emailing us at [email protected] If you opt out, we may still send you non-promotional communications, such as messages about your account or our ongoing business relations.
